These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Le Charme des Violettes, hereinafter referred to as "the seller", and any person making a purchase on the website lecharmedesviolettes.com, hereinafter referred to as "the customer".
Any order placed on the website implies unreserved acceptance of these General Terms and Conditions of Sale.
- Products
Le Charme des Violettes specializes in the sale of antiques, collectibles, antique jewelry, art objects, glassware, porcelain, curiosities and other old or second-hand items.
The products offered are described with the utmost care and illustrated with photographs that are as faithful as possible. The photographs and descriptions are an integral part of the sales contract.
As the items sold are old or second-hand, they may show traces of time, wear or use consistent with their age. These peculiarities are mentioned in the descriptions and/or visible in the photographs.
The customer is invited to carefully examine the photographs and descriptions before any purchase. Defects, restorations, wear and tear or particularities mentioned in the advertisement or visible in the photographs cannot be considered as defects of conformity.
- Prices
Prices are indicated in euros.
The seller benefits from the VAT exemption scheme for small businesses. VAT is therefore not applicable in accordance with current Belgian legislation.
The seller reserves the right to modify its prices at any time. However, products will be invoiced at the rate in force at the time the order is confirmed.
- Order
The customer places their order by following the process proposed on the website.
Before final validation, they can check the details of their order, its total price, and correct any errors.
Confirmation of the order constitutes acceptance of these General Terms and Conditions of Sale.
An order confirmation is sent to the customer by e-mail.
The seller reserves the right to refuse or cancel any order in the event of a previous dispute with the customer or suspicion of fraud.
- Payment
Payment is made online by credit card, PayPal or any other means offered on the website.
Transactions are secured.
The order is only shipped after effective receipt of payment.
- Delivery
The sale price includes delivery costs for parcels up to 3 kg destined for Belgium and France.
Shipments are primarily made via Mondial Relay to the relay point closest to the address provided by the customer.
For parcels over 3 kg, as well as for other destinations, delivery costs are indicated at the time of the order and remain the responsibility of the customer.
Shipments can be made via Mondial Relay, Bpost or any other appropriate carrier.
By choosing the Economy system without tracking, the buyer assumes sole responsibility, if applicable, for the loss of the shipped item.
Delivery times are indicative. A delay attributable to the carrier cannot lead to the cancellation of the sale or the granting of damages.
The risk of loss or damage is transferred to the customer when the customer, or a third party designated by them, takes physical possession of the goods.
6.1 Taxes, customs duties, and import fees
For orders shipped outside the European Union, particularly to Switzerland, the United Kingdom, or any other third country, any customs duties, import taxes, administrative fees, or other local taxes required by the authorities of the destination country are exclusively the responsibility of the customer.
The seller cannot be held responsible for a refusal of import, a delay in customs clearance, or additional fees claimed by the competent authorities of the destination country.
- Right of withdrawal
In accordance with European and Belgian legislation relating to distance contracts, the consumer customer residing in the European Union or benefiting from the protection of this legislation has a period of fourteen (14) calendar days from receipt of the goods to exercise their right of withdrawal without having to justify their decision.

The customer then has a period of fourteen (14) days to return the goods.
Return shipping costs are the responsibility of the customer.
For orders shipped outside the European Union, sales are considered firm and final upon shipment, unless otherwise agreed by the seller or in case of proven non-conformity of the delivered goods.
The returned item must be sent back in its original condition, with any accessories, and in packaging that provides sufficient protection during transport.
Original condition means the condition in which the item was received by the buyer, corresponding to the description and photographs on the website at the time of purchase.
In accordance with Article VI.51 of the Belgian Code of Economic Law, the customer is responsible for any depreciation of the goods resulting from handling other than that necessary to establish their nature, characteristics, and functioning.
In the event of deterioration, breakage, loss of elements, modification, or decrease in value attributable to the customer, the seller may reduce the refunded amount by the amount of the observed loss in value.
After receipt and verification of the returned goods, reimbursement will be made within a maximum of fourteen (14) days.
The seller may defer reimbursement until the goods are recovered or until proof of return shipment is received.
- Unclaimed parcels
When the customer does not collect their parcel within the time limit set by the carrier and it is returned to the seller, the customer is informed by e-mail.
The parcel can be re-sent after payment of new transport costs.
If the customer does not react within six months of notification of the parcel's return, the goods will be considered abandoned and will become the property of the seller without reimbursement of the sums paid.
- Personal data
The personal data collected is used exclusively for processing orders, managing commercial relations and complying with legal obligations.
They are neither sold nor transferred to third parties for commercial purposes.
In accordance with applicable data protection regulations, the customer has a right of access, rectification, limitation, opposition and deletion of their data.

- Intellectual property
All content on the website, including texts, photographs, logos, graphics and descriptions, is protected by intellectual property laws.
Any reproduction, use or distribution, even partial, without the prior written authorization of the seller is prohibited.
- Applicable law and dispute resolution
These General Terms and Conditions of Sale are governed by Belgian law.
In the event of a dispute, the parties undertake to first seek an amicable solution.
Failing an amicable agreement, the courts of the judicial district of the seller's domicile will have jurisdiction to the extent permitted by applicable legislation.
